THE SHAMAN’S LAW FIRM INITIATIVE

IF A CORPORATION IS RECOGNIZED TO BE A PERSON BEFORE THE LAW, THEN SO CAN THE EARTH BE A PERSON BEFORE THE LAW.

Below you will find some bullet points and instructions for how to use the legal system to create precedent that would give us new tools in the fight to preserve our environment. Let’s begin the work to establish standing for the Earth in all international courts.
What follows below are 5 basic principles, followed by a short set of instructions you can use to instruct and motivate attorneys to use the judicial system in new ways.
Shaman’s Law firm recommends annual actions around this initiative that coinside with Earth Day:

THE 5 PRINCIPLES

Nature is alive, and the intelligence we seek in the world is in the forests, the skies, the seas, and all our relations, including the “human being”.

All the ancient peoples, and modern aboriginal or indigenous folks, relate to the Feminine aspects of existence as real, and with their grace we can personally meet them in the person of The Mother Earth

To help the world wake up to this mystery, interested environmental law firms can create a Spring Rite on each Earth Day. A rite where lawsuits are filled with the named plaintiff as the planet. “If a corporation can be a person before the law, then certainly our planet can be a person before the law”

It is not necessary to “win”, for the purpose is to move the riddle from Courts of Law, to the Court of Public Opinion, where folks will be introduced to what can be called the Counter-Copernican Revolution. We are matter and spirit, not just matter.

THE METHOD

We are calling for you to mix legal action with philosophical and environmental advocacy. Asking you to engage in a novel approach to environmental law. The goal is to establish precedent that personifies the planet Earth as a plaintiff in lawsuits, similar to how corporations are treated as legal persons. Someone who takes up this call begins by crafting compelling arguments, and leveraging scientific evidence to support the spiritual and ecological claim that the Earth is a living being, a “Person”.
The ultimate goal isn’t necessarily a legal victory, but raising public awareness and sparking a broader conversation about our relationship with the planet. The strategy is to balance legal rigor with the science, philosophical, and environmental aspects, of the Earth’s status as a living being. Sponsoring lawsuits that serve as a catalyst for public debate and restoration of Earth’s legal status.

ACTION STEPS FOR ATTORNEYS
(Steps you can take)

  1. Craft and file legal arguments showing damages by corporations: Arguments that can be brought before a court whereby it will be argued that the Earth is entitled to monetary and injunctive relief. The practice of the Shaman’s Law Firm approach is to repeatedly seek to establish Earth’s legal standing. Extending these 5 principles, positing and ultimately proving that the planet is a legal entity with rights, and deserving of representation in domestic and international court jurisdictions.
  1. Gather Scientific and Philosophical Evidence: Compile a robust dossier of scientific studies and philosophical arguments that support the interconnectedness of life and the planet’s intrinsic value. This will serve as evidence to counter motions to dismiss, showcasing the rational foundation beneath the spiritual and environmental advocacy.
  2. Design the Legal Complaint: Draft the complaint with a dual focus: it must stand up in court as a legitimate legal document while also being understandable and compelling to the general public. Emphasize the innovative argument that if corporations can be considered legal persons, so too can the planet, framing it in a way that sparks public interest and discussion.
  3. Plan for Public Engagement: Coordinate the filing of lawsuits with a broader public relations strategy. The Spring Rite on Earth Day provides a perfect occasion for this, turning each lawsuit filing into an event that can draw media attention, engage the public, and inspire similar actions globally.
  4. Set Realistic Goals and Prepare for Outcomes: While the primary aim may not be a legal victory, it’s crucial to prepare for all possible outcomes. This includes strategizing for appeals, considering the implications of any judgments, and planning for sustained public engagement campaigns to keep the conversation going, regardless of the court’s decision.
  5. Establish a non profit entity: Create or partner with institutions that fund Indigenous tribes or environmental restoration projects that can be the recipient of any monetary compensation that may result form the suit.

By following these instructions, we can challenge existing legal paradigms but also play a pivotal role in shifting public consciousness and fostering a deeper, more holistic understanding of our relationship with the Earth.
